Mayor Adiong files Motion for Reconsideration

Ordered Dismissed with Perpetual Disqualification from public office by the Ombudsman, the Mayor of this municipality filed a Motion for Reconsideration on October 23, 2015.

In a statement, Public Information Officer Ponod A. Alonto, Jr. told newsmen that “the law gives the Respondent the right to file a Motion for Reconsideration and the right to appeal said Decision.”

The filing by Mayor Ali Untao Adiong of the Motion for Reconsideration has the legal effect of staying the implementation of the decision, he added.

Alonto further stated that “under the law, the Order, directive or decision of the Ombudsman becomes final and executory only after the lapse of the period to appeal, if no appeal is perfected, or after the denial of the appeal from the said order, directive or decision, it is only then shall perforce issue as a matter of right.”

Since Adiong has already filed a motion for reconsideration, the period to perfect the appeal has not yet lapsed and hence the Order cannot yet be executed, Alonto stated.

The statement said that the timely filing of the Motion for Reconsideration of Mayor Adiong restricrts the Department of Interior and Local Government (DILG) from implementing the said Order.

Finally, Alonto assured the people of this municipality of an uninterrupted and normal service of the local government unit under the leadership of Mayor Ali U. Adiong.

It may be recalled that Adiong was charged before the Ombudsman of an Administrative Case for Grave Abuse of Authority, Grave Misconduct and Oppression for allegedly ordering the burning of a boom truck of Jera Construction, a Contractor of Lanao del Sur Electric Cooperative (LASURECO) in erecting electrical poles and stringing transmission lines to muncipalities within the latter’s service area.

In his counter-affidavit he stated that he was not at the scene of the crime directing the burning as alleged in the affidavits of Complainant’s witnesses because he was with barangay officials waiting for representatives of LASURECO for a dialogue when he was informed that the JERA truck was burned so he immediately proceeded to the scene.
